Brief Summary Of New Jerseys Criminal Gun Laws

Gun laws have very much been in the news over the past several years, both in New Jersey and elsewhere in the United States. Some people think that the laws should be tightened, others think that they are too strict. In this post, we will briefly discuss New Jersey’s criminal gun laws.

First of all, there are a number of weapons and accessories that are outlawed in New Jersey. These include sawed-off shotguns, armor-penetrating bullets, silencers, machine guns and unlicensed assault firearms. A person accused of possessing one or more of these items will likely be facing weapons charges. It is also unlawful to possess a defaced firearm. A gun with the serial number filed off would be an example of a defaced firearm. Imitation firearms are also illegal to possess if intended for unlawful use.

There are also certain groups of people who are prohibited from owning firearms. People convicted of certain felonies may not possess firearms. These felonies include homicide, sexual assault, aggravated sexual assault, kidnapping, robbery, arson, aggravated assault, burglary, extortion and escape. The violation of a valid order prohibiting possession of firearms is also illegal.

Persons who have been committed for a mental disorder are also prohibited from possessing firearms. These is an exception for people with satisfactory proof that they no longer have a disorder that handicaps or interferes them in handling a firearm. Also prohibited from possessing guns are persons under the age of 18, persons who are drug dependent and persons with a physical defect which makes it unsafe for them to handle firearms.
