In New Jersey, a DUI (Driving Under the Influence) and a DWI (Driving While Intoxicated) describe the same offense: operating a motor vehicle with a blood alcohol concentration (BAC) of 0.08% or greater, or while impaired by alcohol or drugs. The charge is governed by N.J.S.A. 39:4-50. Unlike most states, New Jersey classifies DWI as a traffic violation rather than a criminal offense, but the penalties, including license loss, fines, surcharges, and mandatory ignition interlock, can still upend your daily life.

DWI charges typically arise after a traffic stop for a moving violation, a sobriety checkpoint, or a motor vehicle accident. Officers rely on standardized field sobriety tests, observations of driving behavior, and the Alcotest 7110 breath instrument. Drivers under 21 face a stricter 0.01% BAC threshold, and commercial drivers face a 0.04% threshold under separate provisions.

Is a DUI a felony in New Jersey?
No. New Jersey is unusual in that DUI / DWI is classified as a traffic offense, not a felony or misdemeanor, under N.J.S.A. 39:4-50. However, the penalties, including license loss, fines, surcharges, and possible jail time, are still significant, and the conviction stays on your driving record permanently.
In most first-offense cases below 0.15% BAC, you may keep your license once an ignition interlock device is installed, rather than serving a hard suspension. For BAC of 0.15% or higher, a 4–6 month suspension typically applies in addition to the interlock requirement.
The standard limit is 0.08% for drivers 21 and over. Drivers under 21 face a 0.01% limit, and commercial drivers face a 0.04% limit under separate provisions. You can also be charged based on observed impairment even if your BAC is below 0.08%.
You may refuse, but New Jersey’s implied consent law (N.J.S.A. 39:4-50.4a) treats refusal as a separate offense with its own license-loss and fine penalties that can run consecutively to a DWI conviction. Refusal is rarely the safer choice and should be discussed with an attorney.
A DWI conviction remains on your New Jersey driving record permanently. Because it is classified as a traffic offense rather than a criminal conviction, it is not eligible for expungement under current New Jersey law.
