Expungement in New Jersey

An expungement is not automatic, but it can change the way you live, work, and apply for opportunities. New Jersey expungement is governed by N.J.S.A. 2C:52-1 et seq.

A successful expungement removes records of arrests and convictions from public view. After a successful expungement, you can lawfully state in most contexts, for employment, housing, and most licensing applications, that the arrest or conviction did not occur. Certain government and law enforcement entities retain access for specific purposes.

New Jersey expungement law has changed dramatically in recent years. The Clean Slate law allows expungement of an entire criminal record after a ten-year waiting period where eligibility requirements are met. The general waiting period for most indictable convictions has been reduced. Marijuana decriminalization legislation provides automatic expungement of qualifying marijuana possession matters. Drug court graduates may apply for expungement at completion.

Not every offense is expungeable. Certain serious offenses are categorically excluded under N.J.S.A. 2C:52-2(b). The strategic question for many petitioners is which records are eligible, on what waiting period, and under which provision of the statute. Mistakes in eligibility analysis can result in denied petitions, making careful early review valuable.

Your matter will proceed in the appropriate court based on the level of the charge and the surrounding facts. Court dates, appearances, filings, and procedural deadlines can become important quickly.

Evidence Review

The records must be gathered from court files, NJ State Police, the Administrative Office of the Courts, and any arresting agencies. Accurate, complete records are essential to a successful petition.

Defense Strategy Development

After reviewing the facts and evidence, the defense can identify potential legal issues, factual challenges, procedural concerns, and the strongest path forward.

What can be expunged in New Jersey?
Most arrests not resulting in conviction, most disorderly persons convictions, most indictable convictions (after qualifying waiting periods), juvenile adjudications, and many marijuana possession matters. Excluded offenses under N.J.S.A. 2C:52-2(b) include most homicides, kidnapping, robbery, sexual assault, certain serious drug distribution offenses, and others.

Recent amendments have shortened many waiting periods. Most indictable convictions are now eligible 5 years after completion of sentence; many disorderly persons convictions on a similar timeline. Arrests not resulting in conviction can be expunged sooner. PTI dismissals have their own shorter timeline. Specific waiting periods depend on the offense and the disposition.

Clean Slate expungement under N.J.S.A. 2C:52-5.3 allows expungement of an entire criminal record after a ten-year period without any new convictions. Clean Slate offers broader relief than regular expungement because it covers all eligible records at once rather than requiring separate petitions for each matter. Categorical exclusions still apply.

Most expungements remove records from NJ databases, meaning they will not appear on most criminal background checks. However, FBI fingerprint-based checks and certain federal employment, immigration, and military checks may still reveal expunged matters. For immigration purposes specifically, expungements do not eliminate the criminal-history disclosure obligation.

Under New Jersey’s cannabis legalization legislation, certain marijuana possession matters are subject to automatic expungement administered by the Administrative Office of the Courts and the State Police. The automatic process covers qualifying matters; other marijuana-related matters may require petition.

After the court enters an Order of Expungement, copies are served on all agencies named in the petition. Each agency removes the records from public-facing systems. The petitioner can then lawfully state the arrest or conviction did not occur in most employment, housing, and licensing contexts. Some specific contexts still require disclosure.

From filing to order, a typical expungement takes 4 to 12 months depending on the vicinage, the prosecutor’s office workload, and whether the State files objections. The waiting period before filing is fixed by statute, but once filed, the actual processing time varies.
